Terms of Service

1. Purpose and acceptance

These terms govern the use of CollabLib, a marketplace connecting content creators and brands, published by RakTiak (SIREN 941 238 685). Creating an account constitutes full acceptance. The service is restricted to adults and, for brands, to professionals.

2. The service

CollabLib lets brands publish paid briefs and gifted product campaigns, and lets creators apply, deliver content and get paid. CollabLib provides matching, messaging, payment escrow and tracking tools.

CollabLib is not a party to the contracts formed between creators and brands: each collaboration is an agreement between them, whose terms (deliverables, deadlines, usage rights) are set by the accepted brief. Payments are processed by Stripe.

3. Accounts

Each account corresponds to one role (creator or brand) chosen at signup and not changeable afterwards. You warrant the accuracy of the information provided and the confidentiality of your credentials. Any activity performed from your account is deemed yours.

4. Paid collaborations and escrow

Paid collaborations follow a flow that protects both parties:

• The brand accepts a proposal and funds the agreed amount, held in escrow by our payment provider.
• The creator delivers the agreed content; the brand approves it or requests a documented revision.
• Upon approval, funds are automatically released to the creator, net of fees. If the brand takes no action within the displayed period, release is automatic.
• In case of disagreement, either party can open a dispute; the CollabLib team arbitrates after review (release, refund or split).

5. Fees

CollabLib charges a 10% service fee on the brand side at payment time (reduced to 8% for paid subscriptions) and an 8% fee on the creator side at payout time. Exact amounts are always displayed before confirmation.

Fees cover matching, escrow, payment infrastructure and support. They are non-refundable once a collaboration has been completed.

6. Brand subscriptions

The Starter plan is free and includes two gifted product campaigns per calendar month. The Pro plan (EUR 49.99 per month or EUR 479.88 per year) raises this limit to ten campaigns, reduces the commission on paid briefs to 8% and includes the benefits listed on the pricing page.

Subscriptions can be cancelled at any time from your settings; cancellation takes effect at the end of the paid period, without pro rata refund. The consumer withdrawal right does not apply to professional services.

7. Gifted products

In gifted product campaigns, the brand ships a product to the selected creator in exchange for the agreed content. The product does not pass through CollabLib and is not a payment made through the platform. Each party remains responsible for its own tax and reporting obligations relating to these exchanges.

8. Content and licences

Creators retain the intellectual property of their content. They grant the brand the usage rights defined in the accepted brief (media, duration, territories). Unless the brief states otherwise, the licence covers use on the brand's own channels.

You grant CollabLib a non-exclusive, free licence to display content published on the platform (profiles, portfolios, deliverables) solely to operate and promote the service.

9. Obligations and prohibitions

By using CollabLib you notably agree to:

• Not use artificial audience practices (purchased followers, automated engagement); displayed statistics must reflect a real audience.
• Comply with advertising transparency: any content resulting from a collaboration must explicitly disclose the partnership, in line with French law no. 2023-451 of June 9, 2023 on commercial influence.
• Not circumvent the platform: collaborations initiated through CollabLib must be concluded and paid through it, for twelve months following the introduction.
• Not publish any unlawful, misleading or infringing content, or content that violates the terms of the social platforms involved.

10. Liability

CollabLib provides the service as is and does not guarantee any volume of applications, campaign results or uninterrupted availability. Subject to mandatory provisions, RakTiak's liability is capped, all damages combined, at the service fees collected during the twelve months preceding the triggering event.

11. Suspension and termination

We may suspend or close an account in case of breach of these terms, fraud or threat to the security of the service, with prior notice except in emergencies. You can delete your account at any time from your settings; ongoing collaborations must be completed or resolved before closure.

12. Governing law

These terms are governed by French law. Consumer users may use the free mediation service mentioned in our legal notice. Failing amicable resolution, the courts of Bobigny have jurisdiction, subject to mandatory rules.
