Order terms
Terms applicable to orders placed by a company with CollabLib (RakTiak, sole trader (entrepreneur individuel, EI), SIREN 941 238 685) from a selection page. They complement the terms of use.
1Purpose
CollabLib provides the content described in the quote, made by the selected creators, as a managed service: selection, contract with each creator, follow-up and report.
2Price and payment
Prices are those of the accepted quote, in euros excluding tax. As long as CollabLib is under the VAT franchise scheme, the mention "TVA non applicable, art. 293 B du CGI" (VAT not applicable) applies and the price paid is the price excluding tax. The order is paid in full when placed. Creators are paid by CollabLib after the content is approved. Any late payment incurs penalties at three times the French legal interest rate and a fixed collection fee of EUR 40. No discount is granted for early payment.
3Performance
The final brief is set with the company before production. Each piece of content includes one revision. Without an answer from the company within 5 business days of delivery, the content is deemed approved. With direct posting, the creator posts on the agreed date and CollabLib checks compliance with the brief.
4Guarantee
Content not delivered on the planned date: the company chooses a new date, another creator or the refund of that creator's share. Content not matching the brief after the included revision: replacement or refund of that creator's share. Compliance is assessed against the approved brief: format and length, product or venue shown, key messages, mandatory mentions, brand tagging, posting date and time online. Refunds are made within 14 days to the payment method used.
5Usage rights
Usage rights are those written in the quote: media, duration and territory. Ad rights are included only if they appear in the quote, for the stated duration.
6Cancellation
Before the creators sign their contracts, the company can cancel the order by email to support@collablib.com and get a full refund. After signature, the guarantee applies.
7Company's commitments
The company provides the products or access to the venue on time, approves or requests the revision within the deadlines, and requests no misleading statement. Publications carry the mention of their commercial nature (French law of 9 June 2023). Delivery of the products is the responsibility of the company and its carrier: CollabLib is not liable for a lost, damaged or late parcel. In that case, the content delivery date is postponed, and CollabLib may step in with the creator and the company in case of a complaint.
8Creators introduced by CollabLib
For 12 months from their introduction by CollabLib (selection page, quote, media kit or shared profile), a creator receives no service order from the company outside CollabLib, directly or through an intermediary, unless CollabLib agrees in writing. During this period, exchanges with the creator about a collaboration go through CollabLib. In case of breach, the company pays CollabLib a compensation equal to 40% of the amount, excluding tax, of each service ordered outside CollabLib.
9Gifted product selection
The selection of creators for a gifted product campaign is free: no payment is requested from the company and no invoice is issued. The refund guarantee of article 4 does not apply; content not delivered on the planned date or not matching the brief after the included revision leads to a new date or replacement by another creator. The company ships the products to the selected creators, and article 7 applies to their delivery. Article 8 applies to the creators introduced.
10Data and disputes
Order data is used to perform and invoice the order. French law; failing an amicable agreement, the courts of CollabLib's registered office have jurisdiction.
